So long story short our tenants had yearly leases until last October, at that point they never resigned and we never made them. They are still under the impression that they have a lease. Since that time the two broke up in February. The women wants to continue her lease but the boyfriend moved out in february. He wants his half of the security deposit but she is going to stay. Not sure what to do with the security deposit. The check was written from the women. Thanks for the help.

If they are on a verbal lease then you can end it with 30 days notice and return the full deposit then they can split it up. You can then require the tenant that wants to stay to give a security deposit and for this new lease you may want to get a Physical lease.
