Landlord Question and Answer Forum
I have a tenent vacating today, the original lease was joint with her husband. They have divorced since then and the husband was removed from the lease at his request earlier this year. He is now demanding the security deposit be refunded to him, but I believe I should only refund it to the current lease holder. Am I correct???

RE: refunding secuirty deposit/divorce and tenent removed from lease situation
The security deposit is for the property, if he wants his half of the security then when the lease is up he needs to settle that with his ex. If he demands it early, you might be able to get the current tenant to pay him out or pay you the half that is sent back. But I am not a lawyer so you may want to get some legal consult on this.
