Landlord Question and Answer Forum
I will be beginning the eviction process on a tenant in Michigan on 11-1-13. The tenant was required to switch the gas account into her name upon moving in on July 1. She has still not done so, which is one of the many lease violations she is being evicted for. If the court upholds the eviction, am I entitled to keep the security deposit? Am I entitled to keep a portion of it for the balance due on the gas bill that she has never paid? Thanks!

Gerald.
Absolutely! You can take out every thing the tenant owes you- back rent, damage in the home, unpaid utilities, etc. as long as you provide a detailed account of what is being taken out.
