We have tenant who does not feel safe and wants to move out. She has sent me multiple texts. All she states is she wants is to move out and pay no penalties. We reluctantly agree (by text) . She states that she will be our by 11:55 PM on Sunday Sept.15, 2013. We agreed by texting back to her. Now she states she can't find a place and wants us to give her move time.
Is her text message and our subsequent agreement to let her out of her contract with no penalties valid?

To answer the question directly, your texts are written record of the agreement, so if they do try to do anything or you do try to collect any kind of fee it is poosible for it to hold up in the case of court action.
