Landlord Question and Answer Forum
I have a signed around lease 15 days prior to the lease beginning, payment for their 1st month’s rent and their deposit funds. They have requested to not move in one day before the lease begins and have all of their funds refunded. My argument with them is that they are still breaking their lease and I could have had the place rented. Their lawyer is arguing with me. Do you feel that I am right or wrong?

How frustrating. If you have a signed lease, its an agreement on rental terms. However, they have an attorney... so that always means $$$. You could try arguing to keep the deposit, covering lost funds with regards to attempting to locate a new tenant. However, they havent moved in so its complicated. Good Luck!
