Landlord Question and Answer Forum
We have a perspective tenant who signed a lease approx. 1 week ago to become effective October 15, 2010. We were to meet today to collect the security deposit. The tenant never showed. We have tried calling with no answer or reply to voice mails. Can we as the landlord declare this lease null and void? If so, what do we have to do to make sure we are not held liable for anything or do we need not worry.

Michael don't take this the wrong way, but what were you thinking signing a lease agreement before receiving the security deposit? At this point, all you can do is start the eviction process, and you'll end up having to learn this lesson the expensive way. I'm sorry for your loss, but at least this is one mistake you won't make again.
