We have a tenant who announced she was moving out at the end of November. We agreed, mainly because she was troublesome and decided it would be simpler rather than fight it, She did not move out because she did not have a place to move to, and she says she will stay until the lease ends at the end of February. Given that we both agreed she will leave by a certain date, does this constitute a mutual agreement to end the lease? Do we still have a lease or not?

Issue notice that you're not renewing the lease. If you try to evict sooner, she can contest any "mutual agreement" in court by saying "It never happened."

If you didn't sign a written agreement for move out, the lease is what counts, you can supersede a written agreement with a verbal one.
