Landlord Question and Answer Forum
We have a husband and wife tenant couple both of whose names are on their lease. He has moved out and she is filing for divorce and a restraining order. She has asked that we issue a new lease in her name only. (The current lease will not expire for many more months.)
Can we legally honor her request and, if so, how?

RE: divorcing tenants
Create a new lease for her have it say that it supersedes any prior agreements between the two of you and create a second document for him to sign that release both parties from the prior lease. Have both sign the docs.
