Is it legal for a tenant to use the security deposit as rent for the last month of occupancy? Unfortunately, the lease I used originally does not address the security deposit. It wasn't through Ezlandlord Forms.

It's not illegal. But it's not what a security deposit is for. The security deposit is for repairs after the tenant moves out that isn't normal wear and tear. So if they use it for rent and there is nothing left how will you pay for repairs?

In some states it is illegal to use the deposit other than anything than repairs upon move it. Usually a lease will say what the deposit is for. Are you able to share the lease with us?
