How long can a guest stay in our California rental before they would be considered a tenant and having to revise the contact with the tenant they are staying with?

Usually a week or two. If you think they've been there for more than two weeks, I'd confront the tenant about it, and sign a new rental contract.

Send them a notice to enter for an inspection, for next weekend. That might put the fear of God into them.
