when is it legal for a tenant to withold rent? and is notice from tenant to landlord necessary?

It's never OK for the tenant to withhold rent. If they have a problem with something the landlord is doing or not doing, for example the landlord has failed to repair something that was advertised as part of the apartment, the tenant's legal recourse is to take the landlord to court over it, at which time a judge will decide who owes who what.
