I have a tenant in one of my apartments that I'm taking to court I new jersey for failing to pay rent. She has a parking spot that she pays a fee to stay in. The parking spot is not included in the lease. However I included the parking fees in the court complaint and documents. We only have a verbal agreement for the parking space. Does she have a right to keep the parking spot and do I have to take that matter up in court? Please advice.

As you're taking her to court for eviction, the judge will decide.
