Landlord Question and Answer Forum
My contract contains the early termination addendum. My Tenant wants to terminate several months before the contract is due to end. The addendum states that she is to give me 60 days notice prior to termination and also states that she agrees to pay $1600 Early Termination Fee.
I would like an interpretation of this so that I am sure to communicate properly to her. Is this stating that she is to pay two months rent, then the $1600 after that?

Yes, she needs to pay for the 60days notice and the $1600 is what is paid to relieve her of any further obligation under the lease. You can also tell her that if she needs to move out early and she returns possession to you that if you find a new tenant to move it before that 60 days is up you will return a the prorated difference.
