I live in South Carolina and my landlord says they pay $40 to take out an eviction notice but charged me $100 when she took one out on me. Is that legal? I heard them tell another tenant this month that they were going to start charging only $40 for the evictIon free from now on. My lease doesn't say anything about how much they can charge for an eviction fee.

That is strange but I would definitely look up your state laws on eviction fees and even contact an attorney. Sounds like they are just making up fees. If the landlord wins the court proceedings the tenant is responsible for the fees associated with the eviction. Definitely look that up.
