Document Description
A Notice to Cease is required as a first step in the eviction process for:
1. Disorderly Conduct that disturbs other Tenants or Neighbors
2. Violations of one of the Landlord's Rules and Regulations
3. Violation of the Lease or Rental Agreement; however, this is
not the case for situations regarding non-payment of rent.
Who: Give this notice to a Tenant who has caused disorderly conduct that disturbs other Tenants or Neighbors and/or violations of one of the Landlord's rules and regulations and/or a violation of the Lease or Rental Agreement EXCEPT for non-payment of rent.
What: The Notice to Cease warns the Tenant to stop the violation.
When: Notice to Cease is given as a warning before a Notice to Quit is served and before an eviction may be started. A "Notice to Cease is not always a requirement.
Important: If a Tenant fails to pay rent, the Landlord may immediately take legal action to have the Tenant evicted. The Landlord is
not required to give the Tenant notice before filing an eviction suit, except if the tenant resides in federally subsidized housing.
