My tenant will not have rent for this month sept which was due in the 1st and if it’s on the 5th with a 5% additional to the rent amount. She tells me now she does not have rent!!!! Could I legally give her a 30 day notice to vacate by Oct 5th? Or could I legally give her a 3 day choice to opt out with a 30 day notice? In my lease, I specifically indicate a 30 day written notice by either landlord or tenant to end the lease agreement. What could I do?

RE: 30 day notice
30 day notice only applies to vacating a unit, not to unpaid rent issues. Issue a five day notice to "Remit or Vacate". The forms are on this site.
