Fixed Term Leases: The days of written notice required (prior to termination) will be as specified within the Lease. No notice given, the Lease terminates at the end of the term.

Notice to Enter

Landlords must give at least 12 hours notice before accessing the rental property. Between the hours of 7:30a-8:00p.

Landlords must disclose within the Lease their contact info or the Landlord's agent's name and address.

Contact your local housing or zoning office to be sure your rental property complies with city and county requirements for inspections, rent control, occupancy limits, property codes, and zoning. Many cities and counties require inspections, registrations and have specific maintenance regulations.

More Pro Tips for Florida Landlords

Here are a few more ProTips to help make you a great Florida Landlord:

  • Florida requires that the signing of all Leases over one year be witnessed; there must be two witnesses for each signature on the document.
  • In Florida, the Landlord must give a Tenant 3 days to pay rent after the rent due date before filing for eviction.
  • In any building with more than 3 stories, the Landlord must tell the Tenant of the option of fire protection.
  • Within 30 days of receiving security deposits, Landlords must disclose in writing whether it will be held in an interest-bearing or non-interest bearing account, the name of the institution where it’s held, and details regarding interest payments.
  • If a Landlord is not withholding a portion of the security deposit, it must be returned within fifteen (15) days of when Tenant leaves the unit or, if you’re withholding a portion, within thirty (30) days.
  • Landlord’s Access - according to Florida statute, the Landlord may access the property by providing “reasonable notice” (12 hours) during the period of 7:30 a.m to 8:00 p.m.
  • Pursuant to state statute 404.056(5), the following language must be included in either the Lease or other documents signed at the time of Leasing: RADON GAS: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county health department.

City and County Ordinances

Whenever renting residential property, it’s important to contact your local housing or zoning office to make sure that you’re in compliance with all local ordinances and regulations.

Here are just a few examples of such ordinances:

  • In Miami, real estate signs advertising a property for rent must comply with color, size, and location requirements.
  • In Tampa, rental certificates are required for residential properties
  • In Broward County, Landlords have to register with the county and pay a $75 fee before renting a property.
