The “5 Day Notice to Cure or Vacate” is a warning, stating that the tenant has violated the lease agreement for something OTHER than non-payment of rent. The notice requires the tenant to fix the violation, vacate the premises OR face eviction.
This notice is used for tenants with tenancies for one year or less
OR year to year tenancies
when the violation has occurred for the first time within one year.
This is given to a tenant who has violated the lease agreement.
The 5-Day- Notice to Cure or Vacate is the required notice used for violations OTHER than non-payment of rent before eviction proceedings are initiated.
Use this notice at least 5 days before filing in the appropriate court for an eviction, provided the tenant has not cured the violation or vacated the leased premises.
