Cleveland 3 Day Notice to Vacate

Giving a tenant notice is the first step in the eviction process. In Cleveland, Ohio, landlords must issue a 3 Day Notice to Vacate as a legally required step in the process. The Notice must contain specific language and formatting that is outlined in the Cleveland, Ohio, law and the Ohio Landlord Tenant Revised Code.

Give this Notice to a tenant who commits a lease violation, breaks the law, or falls behind in rent beyond any applicable grace period. Under Ohio law, lease violations include but are not limited to; failure to pay specified rent by the due date listed in the lease; and staying in the rental unit after the lease has expired or been legally terminated.

This Notice must be carried out in advance of any court filing in an eviction. It serves as a record of who issued the notice and when it was issued.

The 3 Day Notice to Vacate supplies required, legal text. It is used to warn tenants that they must vacate, or eviction proceedings could begin against them. Once Notice has been issued, the landlord must wait three business days (NOT including the day of service OR weekends/holidays) before taking subsequent steps in the eviction process. Subsequent action includes the landlord filing an action of Forcible Entry and Detainer. The Cleveland court where the rental unit is located in the venue for this action. Each court may have individual differences in procedures.
