What: A sublease or sublet agreement is a legal contract, traditionally written between a current tenant of a rental property and a new renter who desires to take over temporary possession of the property. In most circumstances, the original tenant remains liable to the owner or landlord of the rental property.
Who: The parties involved in the contract, the sublessor (sometimes referred to as the sub-landlord) and the lessee (sometimes referred to as a sub-tenant) are identified in the contract.
When: The term of the rental may be for a night, weeks, months, or even years. The sublessor (original tenant on the lease, also referred to as the sub-landlord) remains liable to the original lessor (the landlord/owner of the rental property) for the remainder of the original lease term as well as any applicable renewals, and is ultimately responsible for the payment of rent in addition to any damage to the property.
IMPORTANT: Often, the original lease requires permission from the owner, landlord or agent to enter a sublease arrangement.
Glossary of Terms in this Document
- A written agreement entered into between a Landlord and Tenant, through which the Tenant is granted the right to exclusive use and occupation of the Landlord's residential property for a specified amount of time, and in exchange for an agreed-upon sum of money. Also called a "rental agreement."
- Rental agreement
- A rental agreement is a contract, usually written, between the owner of a property and a renter who desires to have temporary possession of the property. As a minimum, the agreement identifies the parties, the property, the term of the rental, and the amount of rent for the term.
- Gives the Tenant the right to sublease the property if the Tenant cannot fill out the term of the Lease or wants to rent part of its space to someone else. This clause will specify under what conditions the Tenant can avail itself of this right. Under a sublet, the original Tenant is still responsible for honoring the provisions in the Lease.
- A person who has been given the right to use and occupy rental property owned by another person, usually through a Lease or rental agreement. The Tenant's right to exclusive enjoyment of the property is typically granted in exchange for an agreed-upon amount of money, and is limited to a fixed time period (usually set forth in the Lease).
