In the Canadian Province of Alberta, the Residential Tenancies Act governs rental lease agreements and interactions between the landlord and tenant. It provides remedies that the landlord may use when a tenant has breached a rental lease agreement. Landlords must send the proper notice to inform tenants when the lease is being terminated as the result of a lease breach. The notice for non-payment of rent is different from other lease breach notices.

If a tenant has failed to pay rent, landlords in the may give the tenant a notice saying that the tenant must pay the rent that is due or the lease agreement will be terminated. This Alberta Notice to Terminate Tenancy for Non-payment of Rent gives the tenant a payment deadline of 14 full days. The notice states that if the tenant meets the deadline for paying all the rent that is due, then the lease agreement will not be terminated.

    The law requires the notice to be signed by either the landlord or an agent acting on the landlord’s behalf. It must define the reasons for the notice and must include the following:
  • The amount of rent that is due as of the date the notice is being prepared
  • Additional rent that will come due during the 14-day notice period
  • The acceptable payment method that may be used
  • The date the lease will be terminated if the rent is not paid
  • The statement that termination may be avoided by paying back rent on or before the notice deadline

As required by law, the 14 days described in this Alberta Notice to Terminate Tenancy for Non-payment of Rent may not include the day that the notice was served nor the day of the termination.
