That said, you’ll need to know some of them while managing your rental property.

Category State Law
Ending and Renewing Year to Year (no end date in the lease): Advance notice of no less than 90 days is required to end the lease.

Month to Month: 30 days' advance notice is required to end the lease.

Week to Week: 7 days advance notice is required to end the lease.

Fixed Term: Notice is not required, the tenant shall vacate the premises at the end of the lease unless otherwise specified within the lease.
Security Deposit There is no limit placed on the security deposit charged to the tenant so long as it is reasonable.
Returned Payment Fee In Indiana, an amount not to exceed $20, plus an amount equal to the actual charge by the depository institution for each returned or dishonored instrument may be assessed.

Late Fee Late fees should remain reasonable and related to the landlord's actual expenses incurred.
Insurance Requirements Landlords may require tenants to obtain rental insurance, and could make the failure to do so a breach of the lease.
Addenda & Disclosures If the leased premises was constructed prior to 1978, the landlord must provide all tenants with the Lead-Based Paint EPA Disclosure and the Lead-Based Paint EPA Pamphlet.
Notice to Enter Landlords may not access rental units without reasonable notice except for emergencies.
Landlord Requirements Indiana leases for a period longer than three (3) years shall be recorded in the recorder's office of the county in which the real estate is located. IC 32-31-2-1.

Contact your local housing or zoning office to be sure your rental property complies with city and county requirements for inspections, rent control, occupancy limits, property codes, and zoning. Many cities and counties require inspections and registrations and have specific maintenance regulations.

Required Disclosures

Indiana requires the following disclosures to be included in the Lease Package:

  • Lead-Based Paint Disclosure: If the rental property was built before 1978, federal law requires that occupants be provided with a lead-based paint disclosure.
  • Managers and Agents: The Landlord must disclose the name of the person or persons allowed on the Property for repairs or maintenance. Additionally, Tenants must be provided with an address where notices may be sent.

Do Leases in Indiana need to be notarized?
No, Indiana Lease Agreements do not need to be notarized. As long as they’re signed by both the Landlord, or lessor, and Tenant, or lessee, they are considered legally binding and fully enforceable.

How do you write a simple Lease Agreement?
A simple Lease Agreement needs to include all key terms of the rental relationship. This means name and contact information for the Landlord and Tenants, Lease term, rent amount, security deposit amount, and late fee policies.

Residential Leases

While a simple Lease Agreement will cover the basic information, it won’t give Landlords the complete protection they need. Nor will it provide Tenants with all property rules and policies.

To make sure Tenants have the information they need and Landlords have the protection they need, it’s best to avoid writing a generic or simple Lease. And, while there are blank and fillable Lease forms available online, for example, the one offered by the Indiana Association of Realtors, these are lacking.

To make sure you’re setting yourself up for success as a Landlord, it’s a good idea to use a state-specific, customized Lease Agreement any time you rent real estate. This is true whether it’s an apartment, single-family home, duplex, or condo.

What is the standard Lease term in Indiana?
The standard Lease term in Indiana is one year (12 months). However, shorter and longer periods are recognized as long as they’re stated in the Lease Agreement and agreed upon by both parties.

For example: Short-Term Rental Agreements, Month-to-Month Lease Agreements, and Vacation Rental Contracts are all acceptable and fully recognized under Indiana law.

Do new owners have to honor a Lease Agreement in Indiana?
Yes. If you purchase a property with Tenants in place, you are obligated to honor any existing Lease until it ends. While there are some benefits to buying with Tenants already in place, it’s important to see the Lease Agreement before you close on the property to make sure you’re comfortable with the Lease terms. In addition to asking for a copy of the Lease Agreement, it’s a good idea to use an Estoppel Agreement to confirm all terms of the existing Lease.
