Document Description

This is a good notice to use once the Landlord has sufficient proof that a tenant has abandoned the rental property or if the Tenant has vacated and left personal property in the rental unit.

Who: This is given to a Tenant when a Landlord believes the rental unit is abandoned or the Tenant has vacated and left personal property behind.

What: This is an Abandonment of Property Notice informing the Tenant that the rental unit has been abandoned and/or personal property has been left in the rental property.

When: Give this document to your Tenant when you have definite proof that the Tenant has abandoned the rental unit or has vacated the premises leaving personal property behind.

IMPORTANT: Some states have specific procedures to follow before a Landlord may assume possession of the rental property or dispose of any of the tenants personal effects!

Glossary of Terms in this Document

Abandoned Property
Property left behind (often by a Tenant) intentionally and permanently when it appears that the former owner (or Tenant) does not intend to come back, pick it up, or use it.
Abandonment
A Tenant's conduct that demonstrates his or her intent to give up the right to reside in the Leased Premises, without the Landlord's authorization or agreement.
Eviction
A court-based process through which a Landlord may remove a Tenant from the Leased Premises, with good cause and after following a number of procedural requirements. The eviction process is also called "unlawful detainer" in some states.
Re-entry
Taking back possession and going into real property which one owns, particularly when a Tenant has failed to pay rent or has abandoned the Property, or possession has been restored to the owner by judgment in an unlawful detainer lawsuit.
