A Notice to Cease is often required as a first step in the eviction process. However, this is not the case for situations regarding non-payment of rent.
Who: Give this notice to a tenant who has violated any of the reasons as specified within New Jersey State Law. (N.J.S.A. 2A:18-61.1.)
What: The Notice to Cease warns the tenant to stop the violation or face eviction.
When: This is given to a tenant when a violation of the lease has occurred for any of the reasons specified within New Jersey Law. (N.J.S.A. 2A:18-61.1.)
Important: If a tenant fails to pay rent, the landlord may immediately take legal action to have the tenant evicted. The landlord is
not required to give the tenant notice before filing an eviction suit, except if the tenant resides in federally subsidized housing.
