Giving notice is the first step in the eviction process. The notice required in Florida for lease violations
other than non-payment of rent is a 7 Day Notice. After Tenant receives this initial notice to cure and does not remedy the violation within 7 days' then the Tenant would be given a 7 Day termination notice.
Who: Give this to a tenant who violates a lease such as keeping unauthorized pets.
What: This 7 Day Notice gives the tenant the opportunity to fix the problem or vacate the premises.
When: This is given to a tenant as soon as a violation occurs.
PLEASE NOTE: Landlord should be very specific in describing the violation, giving date(s) and time(s), if appropriate.
TIP: Because there are two notices to be served for most cases involving violations other than non-payment of rent, Landlord should allow at least fourteen days before proceeding to eviction in cases that do not involve rental payments.
