Document Description

The Complaint should be filed in the Justice of Peace Court closest to the rental property. "Filing" consists of filling out and returning to the Court the necessary papers. Landlords should make 4 copies of the complaint and any attachments. You should retain one copy for your records and take or mail the original, plus 3 copies, along with the filing fee to the Court. Download this document, print, and fill in the necessary information.

Who: Tenants that have violated a lease agreement.

What: The Delaware Civil Complaint is used to initiate court proceedings and have the tenant evicted.

When: This is served on the tenant after the landlord fills it out and files it with the proper court.
