Document Description
A ten day notice is used when a landlord has a month to month lease, or does not have a written lease and wishes to terminate the tenancy and evict a tenant for any reason.
Who: Give this notice to a tenant without a written lease or who is on a month to month lease when you are ready to evict a tenant for any reason.
What: This is a 10 Day Notice that gives the tenant 10 Days to vacate the premises OR face eviction.
When: This is given to a tenant at least ten days prior to filing an eviction proceeding.
Please note: If the rent is not paid on the date it is due, the law states that thereafter the tenant can still be evicted even if the tenant later tenders payment. The landlord is not required to accept payment.
IMPORTANT : If any part of the rent is accepted after the Notice to Quit has been filed, the owner loses his right to evict.
